Conditions of entry for social media competitions organised by PERI SE

These General Terms and Conditions of Participation apply to all social media competitions organised by PERI SE, Rudolf-Diesel-Straße 19, 89264 Weißenhorn, Germany, hereinafter referred to as "PERI". They may apply in addition to the special conditions of participation announced in the respective competition. In the event of contradictions, the special conditions of participation of the respective competition shall take precedence.

1. Eligibility to participate
Any natural person may participate in their own name. Participants may only enter once per competition, unless multiple entries are expressly permitted. Age restrictions specified in the competition must be observed. Unless otherwise stated in the competition, minors require the consent of their legal guardians to participate, unless this is expressly excluded anyway; the provisions of the German Civil Code (BGB) apply.


Excluded from participation are the legal representatives and employees of PERI, affiliated companies and any co-operation partners, as well as their respective relatives.


2. Participation and realisation
The details of participation and implementation, in particular how and until when participation in the competition is possible and how the winners are selected, will be announced in the respective competition. Participation in the competition is free of charge. Legal recourse is excluded.


If participation in the competition requires the participant to upload or transmit content (e.g. photo or video uploads), only content that has been created by the participant and is free from third-party rights may be transmitted (see also section 5). There is no entitlement to publication of the submitted content.


3. Prize and prize notification
Only the prizes announced in the competition will be awarded. All prizes may only be used for private purposes. A cash payment or transfer of prizes is excluded. Only one prize per participant is possible per competition, unless multiple prizes are expressly permitted.


The winner will be notified immediately by email or social media direct message. The participant is responsible for the accuracy of the email address provided.


Unless expressly stated otherwise in the competition, the claim to the prize will be forfeited without substitution if the winner does not respond within two weeks of being notified of the prize. In this case, a new winner will be chosen from the remaining participants.


The entitlement to the prize shall also be forfeited without substitution if the prize cannot be claimed for reasons attributable to the winner or for reasons for which the winner is responsible.


4. Announcement of the winner
PERI reserves the right to publicly announce the name and place of residence of the winner(s). The participant hereby agrees to this. This consent can be revoked at any time without giving reasons. In this case, however, further participation in the competition may not be possible.


5. Rights of use to transmitted content, third-party rights and legal compliance
Insofar as participation requires the uploading or transmission of certain content (e.g. photo or video upload), the participant grants PERI the rights of use and exploitation of the content transmitted by him/her necessary for the execution and handling of the competition and, if applicable, waives the right to be named as the author in any publication.


The content submitted by the participant must not violate legal regulations, the rights of third parties or public decency. The Participant assures that he/she will not submit any content for which he/she does not have the necessary rights, licences, permissions, consents (e.g. of persons depicted/filmed) or similar. PERI reserves the right to check, edit, delete or block the content submitted by the participants at any time without giving reasons, in particular if it violates legal or official regulations or morality or if publication is not reasonable for PERI or any co-operation partners for other reasons.


6. Premature termination of the competition
PERI reserves the right to terminate the competition at any time without prior notice if, for organisational, technical (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software, deletion of the competition by the social media network) or legal reasons, proper implementation of the competition cannot be guaranteed.


7. Exclusion from the competition
In the event of a breach of these conditions of participation, PERI reserves the right to exclude participants from the competition. Persons who use unauthorised aids or otherwise attempt to gain advantages through manipulation will also be excluded. In such cases, prizes may also be subsequently cancelled and reclaimed. Anyone who provides false personal information is also excluded.

8. Liability
PERI is fully liable for intent and gross negligence as well as for damages resulting from injury to life, body or health.


In the event of slight negligence, PERI is only liable for breaches of a material contractual obligation (cardinal obligation). A cardinal obligation in this sense is an obligation whose fulfilment makes the achievement of the contractual objective possible in the first place and on whose fulfilment the contractual partner therefore relies. In such a case, PERI is not liable for lack of commercial success, lost profits and indirect damages. The liability in such a case is limited to typical, foreseeable damages.


The limitation of liability also applies, with the necessary modifications, to PERI's employees, contractors and vicarious agents.


9. Miscellaneous
The law of the Federal Republic of Germany shall apply insofar as this does not conflict with mandatory international consumer protection law.


Should any of these provisions be or become invalid, this shall not affect the validity of the remaining provisions.

Note on data protection 
The personal data collected via the competition (e.g. social media user names, email addresses) will be used exclusively for the realisation of the competition and then deleted. The winners will be notified by social media direct message or e-mail and, if necessary, asked to provide their postal address so that the prizes can be sent to them. PERI SE will only pass on the winner's address to the logistics service provider (DHL) for the purpose of sending the prize in the event of despatch. No other disclosure to third parties, in particular for advertising purposes, will take place. The legal basis is Art. 6 para. 1 lit. b GDPR. The controller is PERI SE, Rudolf-Diesel-Straße 19, 89264 Weißenhorn, Germany.


If consent to data processing is given as part of the registration process, you are free to withdraw your consent at any time. The revocation should be sent to the contact details above or to content@peri.com You are also entitled to object to the processing. In both cases, the lawfulness of the processing up to the time of the withdrawal of consent or objection is not affected. However, further participation in the competition is then not possible.


You have the right to request information from PERI SE in text form (e.g. letter, fax, e-mail) about which personal data about you is stored by PERI SE. You can request the correction of stored data if it is incorrect. You also have the option of having PERI SE erase data concerning you or restrict its processing. Data that PERI SE requires to complete outstanding tasks or to enforce its own rights and claims, as well as data that PERI SE is required by law to retain, are exempt from erasure. You also have the right to lodge a complaint with a supervisory authority.
